The National Environment Protection Measure (NEPM) for Used Packaging Materials

To ensure that Covenant signatories were not disadvantaged in the marketplace and to encourage participation in the Covenant, the Covenant framework includes a regulatory instrument, the National Environment Protection Measure (NEPM) for Used Packaging Materials. This was established by the National Environment Protection Council (NEPC) and is implemented by mirrored legislation in each State and Territory. 

What this means is that if “Brand Owners” don’t participate in the Covenant they will have to comply with the requirements of the state legislation giving effect to the NEPM. This includes the systematic recovery of the packaging in which their products are sold to the consumer eg. diverting their product packaging from landfill and demonstrating that their packaging is recycled or reused. Under the NEPM “Brand Owners” also implement significant data collection that will allow them to report the types and quantity of packaging they use and how it is collected and reprocessed.

Under the NEPM “Brand Owners” must still submit action plans and annual reports. The difference between Covenant and NEPM plans and reports is that the Covenant allows flexibility. There are set goals, targets and KPI’s however how Signatories address each is flexible. The NEPM is not flexible. It requires that action plans demonstrate ”take back” initiatives for their packaging and that reports are submitted providing rigid data and information. If this information is not supplied or is deemed inadequate local governments may recover kerbside collection costs from “Brand Owners” who contribute to the kerbside waste stream.
